Because the mother and daughter were going to testify against the brother of the killer (for the same sexual abuse), I think I have to assume that the mother was innocent in this.

As the daughter was mentally challenged, it's not a stretch to assume that the mother may have a very low IQ, and perhaps does not possess good inductive/deductive reasoning capabilities.

Ruling: Jetseta Gage died of asphyxiation

    More charges pending against Bentley

By: Dorothyde Souza Guedes - The Gazette

CEDAR RAPIDS, IA - Jetseta Marrie Gage, 10, of Cedar Rapids, died of asphyxiation, the Johnson County Sheriff's Office said last night. An autopsy was conducted at University Hospitals in Iowa City by an assistant state medical examiner, and Gage's death is now considered a homicide.

A disheveled but calm Roger Paul Bentley appeared in Linn County District Court on Saturday, accused of child stealing in connection with taking Gage from her Cedar Rapids home Thursday evening. He faces additional charges in Johnson County District Court, where he is to make an additional appearance Monday morning.

Bentley, 37, of Brandon, is being held in the Linn County Jail in lieu of $1 million bail.

Jetseta's disappearance triggered a statewide Amber Alert that Cedar Rapids police canceled at 2 p.m. Friday, saying a body had been found in rural Johnson County.

The Johnson County Sheriff's Office did not confirm until last night that the body found in a rundown mobile home near Frytown on Friday was that of Jetseta.

Bentley, a registered sex offender, is accused of taking Jetseta from her home at 448 Jacolyn Dr. NW at 8:15 p.m. Thursday. The child's disappearance was reported to police at 8:47 p.m., and Bentley was sought in connection with the disappearance from the beginning.

A person who saw the Amber Alert on Friday morning called police to report seeing Bentley or his pickup at the abandoned mobile home at 4703 Orval Yoder Turnpike in rural Kalona.

Johnson County Sheriff's deputies went to the mobile home at 7 a.m. Friday, found the body and took Bentley into custody. He was transferred to the Linn County Jail about 9:30 p.m. Friday.

Jetseta's mother, Trena Gage, 29, referred to Bentley as a family friend and said she did not know he was on the Iowa Sex Offender Registry.

Bentley was convicted in 1994 in Benton County of lascivious acts with a 7-year-old girl. He spent just over two years in prison at Mount Pleasant.

Bentley made his initial appearance on the child stealing charge, a Class C felony, in the Linn County Jail's video courtroom at 9:30 a.m. Saturday.

Associate District Judge Barbara Leisveld questioned Bentley about his application for a court-appointed attorney. He indicated he was self-employed and that his last monthly income was three to four months ago. The judge appointed the Linn County Advocate to represent Bentley.

Assistant Linn County Attorney Laurie Craig asked that the court set a $1 million cash-only bail for Bentley because of the facts and circumstances of the crime and for the protection of the community. The judge agreed.

Even if Bentley were able to post bail, a Johnson County "hold" would prevent his release.

"I think it's important to note that additional charges are contemplated and could be filed, depending on what the police find in their investigation," First Assistant Linn County Attorney Jerry Vander Sanden said after Bentley's court appearance.

It's unusual for a case to begin in one county and end in another, he said. The Linn County and Johnson County attorney's offices are working together on the case. The charge of child stealing is supported by the evidence now known, Vander Sanden said.

With a kidnapping charge, the state would have to prove that a suspect intended to commit other acts, such as sexual assault, torture or hold for ransom.

The incident is being investigated by the Cedar Rapids Police Department, Johnson County Sheriff's Office and Iowa Division of Criminal Investigation.

"The whole thing is a collaborative effort," Vander Sanden said.

Trena Gage said she met Bentley when she was dating his brother, James Bentley.

James Bentley, 33, of Vinton, is now in the Linn County Jail on a charge of second-degree sexual abuse of a 10-year-old girl over the course of more than two years. Trena Gage on Friday identified Jetseta as the victim in that charge. The Johnson County Sheriff's Office Saturday night also said Jetseta was the victim in that case.
