Speakout: Karr a modern-day Elephant Man
    By Gary Harris
    September 18, 2006

Before succumbing to the high farce being perpetrated against John Mark Karr by the Boulder-Sonoma axis, News readers might want to consider the following facts:

Before Boulder District Attorney Mary Lacy initially lined up Karr for death row in the JonBenet Ramsey murder case, there was no hint he had ever abused a child - by all accounts, he was a loving father to his three sons. Karr has no history of drug abuse, crime or violence. He is an animal rescuer and has a keen sense of humor. Though highly intelligent, Karr can be argumentative and temperamental and cannot keep a job.

Behavioral scientists tell us that psychopaths and pedophiles do not wait until age 37 to manifest their demons; instead they begin setting fires, torturing animals, peeping into windows, molesting children and exhibiting violent propensities early on. Karr has never exhibited any of these traits.

The murder of JonBenet Ramsey at Christmastime 1996 mesmerized Karr and, while living in Hamilton, Alabama, he began obsessively compiling information for a book about her which his father, Wex Karr, had suggested he write.

In July 2000, Karr sold his meager possessions, loaded his wife and three sons into their beat-up van and set out for California where, in the spring of 2001, Karr met Wendy Hutchens, longtime friend of Richard Allen Davis, the infamous murderer of 12-year-old Polly Klaas. Karr wanted to interview Davis to gain insight into the psyche of a child murderer. Hutchens gave Karr an entree to Davis and he interviewed him in prison.

At some point early on in their relationship, Hutchens apparently became persuaded of Karr's involvement in the Ramsey case, contacted law enforcement officials and began taping her conversations with him. (Although a purported 10 hours of recordings were made, we have to wonder why less than 1 percent of the tapes have been aired.) At the beginning of one of the tapes we have heard, Hutchens asks Karr to profile JonBenet's killer: How did he kill her? What was going through his mind? (In one of Karr's instant messages to University of Colorado communications professor Michael Tracey, he explains how Hutchens persisted in her requests to entrap him into playing the role of JonBenet's killer.)

Karr relented and Hutchens eventually turned the tapes over to those she had contacted at the FBI and Sonoma County Sheriff's Department, laying claim to the $100,000 reward being offered by the Ramsey camp.

If the tapes incriminated Karr in JonBenet's murder, why did Hutchens fail to collect a dime? If the tapes did not implicate Karr in the crime, they certainly could not have formed the basis for the issuance of a valid search warrant.

Nevertheless, Sonoma proceeded to raid Karr's home in April 2001, seize his computer and charge him with possession of five photos depicting "child pornography" despite the fact they had been deleted and buried in the unallocated space on the computer, thus rendering the photos inaccessible to Karr. It took a highly trained computer expert using sophisticated software techniques to recover the photos before Sonoma could view them.

Can we not presume that Sonoma has determined the name(s) and age(s) of the depicted "child" or "children" during the five years since Karr's arrest? If not, Karr's acquittal under the California statute in question is a certainty. Moreover, why has Sonoma refused to release the police report, warrant affidavit, etc., to the public as required under California law?

Karr remained in jail for six months under a $100,000 bond - unprecedented in the history of the American criminal justice system. Violent felons are routinely released on much lower bonds every day in America. The purpose of a bond is not to keep the defendant in jail while awaiting trial, but rather to ensure his presence at trial. Given the lack of any criminal record, Karr should have been released on his own recognizance. We can only try to imagine the hostile treatment he received while incarcerated; it is little wonder he ran as soon as he was released.

Meanwhile, Sonoma says it gave the Hutchens tapes to Boulder in 2001, but Mary Lacy proclaimed to the world on Aug. 29, 2006, that she had never heard of Karr or the Hutchens tapes until August 2006. It strains credulity to believe that Sonoma and the FBI procured tapes that ostensibly deal with one of the most famous unsolved murder cases in American history, but simply failed to notify Boulder. Either Sonoma or Boulder is lying and fully engaged in a giant cover-up of their incompetence.

John Karr's life has been destroyed. He can never work again. He will probably never be allowed to see his children again. Karr has been turned into a modern-day Elephant Man to be stared at, cursed, physically attacked, and vilified for the rest of his life.

*Gary Harris has practiced law in Georgia for 39 years and lives with his wife in the northeast Georgia mountains. Although he has represented various Karr family members in civil matters over last 20 years, the opinions expressed herein are solely his own.

    Bail Hearing now

John Mark Karr due in court his morning for bail hearing
SANTA ROSA (AP) - The one-time suspect in the JonBenet Ramsey case is set to return to court in Santa Rosa today.

John Mark Karr is due in court on a bail hearing this morning (10:30).

Karr is currently being held without bail on suspicion of misdemeanor child pornography charges dating back more than five years.

His attorneys will seek to have bail set and will argue for his release.

Five misdemeanor counts of possessing child pornography have been pending against Karr in Sonoma County since authorities arrested him in April of 2001.

After the arrest, police seized his computer and said that the hard drive contained five sexually oriented images of children.

Karr pleaded not guilty to all counts then, and was jailed for six months. But he fled the country before he could be tried.

    Re Hutchens ...

River, I've said it from the get go that I couldn't stand that Hutchens weirdo. After all, you have to question someone who apparently was originally a friend of Polly Klass's murderer.

This whole Karr situation is a total travesty of justice and I doubt that we will ever get to know the truth behind Lacy, Tracy, et al, including John Ramsey, who must have known all along that Karr was an innocent dupe in the Jonbenet case.

You have to wonder why Lin Wood, who defended Richard Jewel & became rich/famous for that case, wouldn't be out there trying to sue on behalf of Karr .... well huh, maybe because he too was part of the orchestration that brought yet another innocent bystander into the mix of their "Intruder" dit it theories, just in time for the 10th Anniversary show.

Shame on all of them .... I'm surprised that one of them didn't pull a "Jack Ruby" on JMK. Maybe they didn't get the opportunity.

    Regards,
    Mandarin

Speaking of John Ramsey, seems he's gone back in his rabbit hole after the Karr fiasco. One has to wonder what he's hiding from, or rather, what he has to hide.

    And Speaking Of Lawyers,

there is an article in todays San Jose Mercury News about the 2 lady attys who announced at a news conference they would represent the JMK last month.
The article goes on with this, "Throughout the extradition proceedings that took Karr from CA to Boulder and back again for his Thursday appearance in Sonoma County on Child-porn misdemeanor charges neither Jamie Harmon nor Patience Van Zandt have made a single appearance on his behalf. At each of his hearings he was represented by other attys. It's unclear what happened.

While Van Zandt showed a reporter a document that seemed to indicate Karr had retained then, Colorado officials said Karr was not interested in seeing Harmon. They allege Harmon at one point lied in an attempt to arrange a jailhouse meeting with him. A San Francisco private atty now represents Karr in the Sonoma case.

Harmon and Van Zandt have tried to talk to Karr to determine if he still wants them to represent him but have been rebuffed, they said. "It's bizarre we should be denied access to our client," Van Zandt said.

Boulder Deputy Public Defender Seth Temin, who represented Karr in Colorado said, "I had great concerns about these people trying to inject themselves into this case apparently for reasons other than the protection and representation of Mr. Karr's interest."

Van Zandt, who as a Sonoma Co. deputy public defender had been assigned to Karr's child-porn case in 2001. Harmon, a former Santa Clara Co prosecutor who was cited three times by judges for giving incorrect legal advice, tried to see Karr twice in the Boulder Co jail but was prevented each time because she is not licensed or approved to practice law in Colorado. On one occasion while Karr was in colorado, Harmon told jailers she had the permission of the public defender's office to see Karr, which was not true, Temin said.

Now back in Sonoma Co Karr will be defended by Public Defender John Abrahams and face the charges he fled from five years ago. Abrahams said his office "never received anything to indicate" from Van Zandt or Harmon that they would represent him. Van Zandt hopes to see him again to clarify -- at least for her -- his legal situation. "I just want to know what he wants," she said.

I have to say there is a conflict in the article by saying he will be represented b;y two different attys. The article does not make it clear who is or isn't going to represent him.

You know, WY, I've been thinking about that same thing.

I was going to ask Why_Nut for the exact days and times John flew his plane from Charlevoix to Pigeon Forge and back. If I remember right, John went into hiding before Karr even got to America, and he didn't come out until right before Lacy announced Karr didn't match the DNA. Of course, John got a phone call from Lacy telling him about it a day before even Karr's attorney knew it didn't match. I need to research and find exactly what she said. I'd like to get a timeline established.

*Michael Tracey (with help from Lou Smit) e-mails John Karr for four years, trying to get Karr's "confession" story to match Lou Smit's theory of an intruder in the Ramsey case.

*In early August 2006, Tracey becomes concerned that Karr is going to disappear because Karr goes further into his depression, and starts making vague threats, from being upset at not getting to meet Patsy before she dies on June 24, 2006.

*Lacy says she calls John for advice about Karr.

*Thai authorities arrest Karr in Thailand at the request of the Boulder DA.

*Dan Abrams at MSNBC says John Ramsey calls him and makes sure they have the scoop on the arrest of Karr, including Karr's name.

*John Ramsey issues a short statement regarding Karr's assumed innocence.

*Lin Wood congratulates himself on the innocence of the Ramseys, and proclaims the Ramseys "exhonerated."

*John Ramsey has a hissy fit when when media arrives in Charlevoix, and at Purdue University where Burke is starting his sophomore year in college.

*Lin Wood threatens Wendy Murphy with a lawsuit for questioning the intruder theory.

*John Ramsey flies from Charlevoix and goes into hiding somewhere near Pigeon Forge, TN in the Great Smoky Mountains.

*Karr arrives in the US, and the farce continues.

*Pam Paugh and the Ramsey family proclaim Patsy vindicated and give tours of her gravesite.

*All the talking media air-heads bring the same bogus handwriting analysts, Baggett and Lehew, on their shows to announce Karr is the ransom note writer. Baggett stakes his reputation on the claim and says he is 99.9% sure Karr is the author.

*Lacy brings Karr to Boulder so she can get a cheek swab done in Colorado. She immediately calls John Ramsey, and Michael Tracey, with the negative results.

*John Ramsey flies back to Charlevoix.

*A day later, Lacy calls Karr's attorney, and tells him the DNA does not match.

*As the world watches, Lacy admits (in the most ridiculous law enforcement press conference seen this side of Daffy Duck) that she is criminally incompetent and doesn't know her head from a hole in the ground. With the facial expressions, and verbal aplomb of a kindergarten teacher explaining potty etiquette, Lacy admits the DNA (which may be an artifact) does not match Karr.

*Lin Wood does not retract his exhoneration.

*John Ramsey does not coming out of hiding to speak.

*The talking air-heads do not have Baggett and Lehew back on their TV shows to apologize to Karr, or to eat crow. (What happened to the 99.9% sure, eh Bag-head? You give REAL handwriting analysis a bad name.)

*Pam Paugh slinks back to her happy meal.

*Boulder and the media try to bury the story on page 29.

Maybe John Ramsey might end up being the Mayor of Michigan (?). Or, maybe Town Councellor (?). He can then be on their local TV at those boring weekly meetings.
