New 48 Hours Rebuttal Thread

    Ok guys. WE ( notice I said WE) have a project.

    We took apart the Judge's decision in the case. Now we must do the same?

    Why? Because we can. Because we, as in the people on the Internet who care, are the ones left to tell the truth. Also, you never know who may read it. ;)

    BobC, I am going to need you. Are you up for it? What do I need to do for you to get you to bring your brilliant understanding of this case to our project?

    The 48 Hours documentary didn't start until 10:00 pm in Canada, and I have to agree with Little, it was just a rehash with embellishment on the parts we all know are false. There was no mention that one of the footprints was found to be Burke's.

    A rope was found under the bed. So what!? There was no rope of this type used on JonBenét. The white flat type of trim cord which Patsy Ramsey has around a Navy blue jacket, is the same type of cord used for the "half a-s-s-e-d garrote. So what the hell is the fuss over this rope under the bed? This type of rope was used for a modelling session. Get the facts straight 48 Hours!

    Could Erin Moriarty's skirt have been any shorter as she sat across from that creep Michael Helgoth? However, she was quite safe since he just went after babies.

    As for the private detective driving around Boulder checking on the night action of the burglars, they never even displayed one getting caught in the act. (?) ...so what was the big deal in giving us this information without proof?

    I don't know how "brilliant" it is--but yeah I'm in. This is frikkin hilarious! The PI's aren't getting paid! For almost ten years now! LOL!!!! This whole case has turned camp! I have a bridge in Brooklyn that is now up for auction! I give discount rates to FFJ members!

    The Ramseys are INNOCENT!! I cannot believe that fraud Henry Lee forgot to mention in his book that DNA cleared the parents!!! What the hell do we pay that guy for? He's FIRED!!!

    Here is the odd footnote. I was told by one of the producers of 48 hours last fall that the show was going to be about Henry Lee and his new book. Tracey's crap was just a little bit of it.

    Granted this was way back in September but I sure didn't see any mention of Henry Lee's new book on Saturday.

    Dear Show Me and other members of the forum, Thank you all for all the recent postings. I've been away a long time because I reached a point where the pain of my work on this got too much to handle. Which doesn't mean I've given up the fight. An update: within the next year there will be three long and favorable reviews of my JonBenet book in psychoanalytic journals. I'm also happy to report that the book is catching on among psychoanalysts. (I add the necessary footnote to Jameson and Lin Wood: all profits from the book and play are donated to organizations that work on behalf of sexually abused children.) Several important theatres remain interested in possibly producing the play. I'm hoping the journal reviews will nudge them along. And in all this I can assure all of you I await with relish Lin Wood's promise to sue me. Others may cave to his fascist tactics. I can assure you I won't. Finally, let me thank all of you for keeping this forum going. I find the dedication that Tricia and all of you show to her deeply moving. Holiday best wishes to all, walter (mac) davis

    I saw San and Ollie on FOX this afternoon. (Kookla must have been tied up at the Heidelberger Cafe solving some other unsolved cases with the Old Farts Club from El Paso County.)

    San did most of the talking, while Ollie grunted out a few Amens. How anyone could believe their colossal lies, without a shred of evidence to back up their tall tales, is beyond me.

    Why does FOX even invite them on? Comic relief?? :sponge:

    Man fondled girl who was in same dance class as JonBenet

    BOULDER — Police are reviewing evidence again in an unsolved 1997 sexual assault case to see if it might be connected to the 31/2-year-old slaying of JonBenet Ramsey, Chief Mark Beckner said Tuesday.

    Beckner said detectives in September 1997 compared evidence and circumstances surrounding the unsolved case to the December 1996 slaying of 6-year-old JonBenet, who was found dead in her parents' basement.

    Beckner said he decided last week to have a detective again review reports of the unsolved sexual assault, in which a 14-year-old was fondled by an intruder in her north Boulder home in September 1997. The intruder was frightened away when the girl's mother heard whispering in her daughter's room and went to investigate.

    The girl attended the same dance academy as JonBenet.

    Police in 1997 found no connection between the Ramsey case and the sexual assault. There are no suspects in the sexual assault, and Beckner said there are no plans to retest evidence in that case, including handprints allegedly made by the intruder, but evidence will be reviewed.

    "I was called last week by a reporter about the case, and I decided we should review it again to see if there is anything else that might be done primarily to solve that case," Beckner said. "That is our first priority. Certainly, if things fell into place and there was evidence that pointed to someone who might have been involved in the Ramsey murder, that would be great.

    "We are right in the middle on this one, in that we can't discount any possibility. Could it be related? Sure. Could it be unrelated? Sure. We just don't know," he said.

    Beckner assumed supervision of the troubled Ramsey investigation in fall 1997.

    Meanwhile, Boulder detectives still involved part-time in the long and expensive investigation plan to go to Atlanta later this month to re-interview JonBenet's parents, John and Patsy Ramsey. Beckner has said detectives want to ask the couple questions about new information that has developed since the Ramseys were last interviewed by investigators from the Boulder District Attorney's Office in June 1998.

    I have posted about this before but I will try to explain it again in simple terms. I also invite all of you to try it with a toy gun or an unloaded real gun.

    Take the toy gun in your right hand, and aim it towards your chest and heart. It is very arkward to use your second finger in the trigger, it is more comfortable to use your thumb. When your thumb is used, the gun will naturally slide to give a left to right trajectory.The gun will drop to the right.


    MANY suicide victims who shoot themseves in the chest use their thumbs on the trigger, and hence, the trajectory is left to right. Just like Helgoth's autopsy.

    It is standard procedure to check the victim for hammer spur impressions on the fingers which match up to the gun, gunshot residue, and blood splatter which would indicate suicide or homicide. Since we have never seen these reports, which would be police reports and NOT part of the autopsy- and not available to the public-we do not know what they say, but I am certain that they are indicitive of suicide. And you know if they were not, these stooges would be touting additional evidence besides their left to right fraud.

    You did what 48 Hours SHOULD HAVE DONE. Checked the facts. What a concept right?

    One of these is Smit, who initailly sabotaged his integrity and impartiality by meeting and praying with the R’s.

    This alone compromises their ability to be impartial and conduct an unbiased investigation.


    “…Detectives working for the Boulder district attorney….,are finally concentrating their efforts on the underside of Boulder that was largely ignored during the initial investigation. “

    And what do they mean by “Finally�



    “Within a two-mile radius of where the Ramseys once lived, 38 of their neighbors are registered sex offenders.â€

    “From the outset, police never seriously considered the evidence that someone outside the Ramsey family may have killed JonBenet.â€

    This is a lie. Exactly what evidence pointed to an outsider? Even John said it was an inside job. And who else in the beginning was suspect besides the hightailing lawyer hiring R’s? And the R’s immediately threw all of their friends under the bus from the get go and they were all investigated with a fine toothed comb, as were other suspects such as Colfax, Bootman, Santa Bill and others I can't think of right now.


    "This murder was not conducted upstairs in a nice bedroom. This murder was conducted in a basement, and it was very vicious." Smit.

    Were fibers from the rope found on the bed sheets or is this an internet rumor?


    “Autopsy results showed evidence that JonBenet may have been subdued with a stun gun.â€

    This is a lie. Nothing in the autopsy indicates stun gun use.


    “The current investigation also focuses on the possibility of two intruders, because of two very clear, and different, boot prints in the room where JonBenet was found.â€

    Weren’t one of these prints determined to be from Burke’s shoes?


    “And, there's another clue investigators are interested in: a rope found in the bedroom next to JonBenet's. “

    ? What does this rope have to do with JonBenet’s murder?



    “….a report of an unknown blue van spotted outside the Ramsey house the night before and the day after JonBenet was murdered.â€

    Is this the same van JR said he saw looking out the window and told BPD A FEW HOURS after seeing it?

    Exactly! So why haven’t foreign fibers, substantial DNA, fingerprints been found outside of the family?

    “(LeBerge) believes he has the DNA for the man he suspects is the killer of JonBenet Ramsey. “

    Is this factual or just a belief?


    â€It has taken years to isolate, but forensic scientists in Colorado now have a complete DNA profile of the killer. They know the killer is a male.â€

    " ‘Right now, the DNA profile that's in hand doesn't match anyone associated with the investigation, so that would include the parents,’ says LaBerge, the Denver police scientist who believes this is the last and best hope to crack the case. ‘If the DNA never matches someone, the case, depending on the rest of the investigation, may never be solved.’ â€
    Is this true? What is Henry Lee’s take on this? Didn’t he say this is not a DNA case? Isn’t the DNA too degraded or minute to match anyone?



    “Augustin and Gray (R’s detectives) are convinced that the DNA sample belongs to JonBenet's killer, because of a small amount of matching DNA that also was found under the 6-year-old murder victim's fingernails. “

    Again, isn’t this DNA too degraded to match anyone? And did the fingernail and panty DNA match each other?





    “…the DA's office is using this DNA profile to investigate several suspects in the case. …One of those suspects came to lightâ€

    This DNA doesn’t match Helgoth or the Candy Cane Man, so why bother to bring them in on the show?



    “ ’Mike was pretty happy around late November, about him and a partner making a killer deal, and they were each gonna make $50,000 or $60,000.’ " Kenady

    B]So why haven’t the R’s investigators found all his acquaintances and swabbed them????[/B]

    " ‘Then Christmas goes -- comes. And then he's really depressed. And there's no money. And then he said that he wanted to crack a human skull…’" Kenady

    Now is Kenady saying that Helgoth said he wanted to crack a human skull AFTER CHRISTMAS? AFTER the murder?


    " ‘His friends say that he owns several stun guns, that he was a gun nut…’ " Gray

    “The stun gun is important because Gray and San Augustin believe, from examining autopsy photos, that JonBenet was incapacitated with one at some point during her attack.â€

    “ ‘In that time frame, 1995-95 time frame, the only stun gun that had a laser sight on it was Air Taser,’ " says Gray, who adds that he believes this was the same type of stun gun used on JonBenet.â€

    Nevermind what they believe, where’s the proof? What stun guns did Helgoth own? And what, in their “expert†opinion, leads them to the conclusion that a stun gun, IF one was used, was Helgoths? Where’s the proof of any of it?????


    “San Augustin showed 48 Hours the underside of Helgoth's boot. ‘On the left is the high tech impression that was made in the area where JonBenet's body was found,’ says San Augustin.

    “ ‘There's no reason for Helgoth's boot to be in the Ramsey home where JonBenet's body was found.’ " Exactly!


    “The investigators turned the boots over to the Boulder police, who NOWclaim their investigation showed they were the wrong size for a match.â€

    BPD claimed this years ago. Why did 48 Hours even go down this path?




    “But they have yet to be turned over to the district attorney for further analysis.â€

    Why not? Oh, never mind, why bother??? The rest of the Helgoth saga is not worth going over. Nothing, not his fibers, fingerprints, DNA were left at the crime scene. He is a dead end moot non-suspect.

    “But there is one thing investigators are sure of: Helgoth's DNA does not match the DNA profile sitting in the Denver crime lab.†Same with Olivia. So why bother reporting on either one of them?




    “But the Boulder DA investigators still have a list of people they'd like to talk to, reportedly more than 100 names – including Oliva and anyone who can shed more light on the mysterious death of Michael Helgoth. “

    Well? What’s stopping them? Olivia can be eliminated. Seems they are trying to fabricate a Helgoth connection.


    " ‘If you look at the case real close, you'll see that quite possibly there was more than one person involved,’ says San Augustin.â€

    Yes, and they are still under that pesky umbrella.


    “How did 6-year-old JonBenet become a target? Gray and San Augustin have a theory of how she may have been marked for death.â€

    Never mind theories. Everybody I know has one. Where’s the proof?



    “Before going to bed, Amy's mother turned on the burglar alarm. Around midnight, Amy woke up to find a man standing over her bed, his hand over her mouth. ‘She remembered the intruder addressing her by her name,’ says Peterson. ‘He said, “I know who you are.†' He repeated those things a few times, apparently. “I'll knock you out. Shut up.†"

    Where was his stun gun? Not the same MO.

    "He (Peterson) made surveillance videotapes, and showed 48 Hours vehicles that he believes were used by a roving band of criminals. ‘We did tail them at one point, within two blocks from the Ramsey house,’ says Peterson, who watched the neighborhood for weeks. “

    And did Peterson catch anyone doing anything? Where’s the proof they were a “roving band of criminals�??? This sounds like a line meant for the infamous ransom note.



    “48 Hours has discovered that, of Colorado's most dangerous sex offenders, one in eight also has prior convictions for burglary or robbery. ‘They burglarize and sexually assault if the opportunity presents itself,’ says Peterson.

    This is not uncommon at all among rapists. Breaking and entering is the pre-text.


    “He (Peterson) did background checks on his suspects in Amy's case, and discovered that some of them had at one time worked at the Ramsey home. “

    AND???? What else did he discover? And why weren’t the swabs brought out?!



    “Peterson, who went so far as to collect the sample of one man's handwriting. ‘We talked with him several times. ...We had him write something.‘

    "Peterson then had an expert compare that handwriting to the Ramsey ransom note. He claims he found distinct similarities were found, but " ’ handwriting analysis is kind of an art. It's pretty subjective.’ "

    Guess it wasn’t a match. Did it have more similarities than Patsy’s handwriting?


    â€He also collected cigarette butts found outside Amy's house, and discovered that the ‘same brands were found in the Ramseys' alley’ ."

    Why haven’t those cigarette butt filters DNA been matched with the ones found in the Ramsey alley? That would prove something one way or the other.


    “…but a grand jury failed to indict the Ramseys -– in large part because of one critical piece of evidence. It was the unexplained male DNA in JonBenet's underwear.â€

    How does 48 Hours know this? Isn’t all of this still sealed?

    “Now, the same DNA that saved the Ramseys from indictment is finally being used to check out the dozens and dozens of suspects who were ignored for years.â€

    Well? Where’s the beef? And again, isn’t this DNA too degraded or minute to match anyone?



    “48 Hours reports that there is now what's believed to be a complete DNA profileof JonBenet Ramsey's killer.â€

    Never mind what is BELIEVED, and by WHO? How about some proof???? Who says there IS a complete DNA profile? And if so, why wasn’t Henry Lee consulted on this? What is his legitimately expert opinion on this new information?

    “ And there's strong evidence that he may have had an accomplice and that he may have tried to kill again. “

    What evidence? All that’s evident is BELIEFS, not PROOF. And “May Haves†don’t make it so.

    I thought this was a one sided, biased and blatantly false program.

    I also think they are irresponsible or sorely uniformed of the facts. Where was the rebuttal or the challenge to each point of nonsense? It’s unfortunate that people who haven’t followed the case or aren’t up on the facts will believe this crock and the untruths, or the fence sitters will be swayed to fall into this pit of lies.

    48 Hours did a disgusting disservice to justice and the viewing public airing this time wasting unbalanced program.

    And yes, all of the above is just my opinion.

    Excellent letter. Something jumped out at me as I re-read this:

    Was the Ramsey's home burglarized? Was anything of value missing?

    I also am curious about the TWO footprints. I have only heard about one. Are these from different footwear? Does anyone have additional information about this?

    And to expand on what I said above concerning the determination of suicide, here is San Augstin's quote, and the idiot narrator of 48 Hours:

    Most surprising of all, however, was the nature of Helgoth's suicide. Investigators initially said he died from a bullet to his head. But in fact, Gray says, the fatal shot was nowhere near his head.

    "The gun was found on Michael's right and he's right-handed," says Gray. "The bullet hole is on Michael's left and it goes across the body from left to right."

    "It became really odd to us that he would then take the gun and bring it around and then try and shoot himself," adds San Augustin. "It doesn't make sense why you would have somebody commit suicide in that manner."

    The investigators were left with only one conclusion. Someone killed Helgoth. Why?


    Please try holding the gun with your thumb on the trigger, Mr. San Agustine and the gun will automatically slide to produce a left to right trajectory. I believe that the coroner and police know this when they determined it was suicide because they have seen it time and time again. I really wonder how many death investigations Mr. San Agustine has done in any sort of official capacity.

    48 Hours/CBS is a joke. I will never watch or believe any of their news programs again after knowing how inaccurate, deceptive and fraudulant this show was.

    Terrific email, Trish! This non-member is really well-informed as to the facts of the case. It's nice to know that FFJ can provide so much information to "lurkers" so that they are fully informed on the case. That makes our efforts all worthwhile.

    S/he states: "'But there is one thing investigators are sure of: Helgoth's DNA does not match the DNA profile sitting in the Denver crime lab.' Same with Olivia. So why bother reporting on either one of them?"

    This was my main point as well. How many times are Helgoth, Olivia and everyone else whose DNA does not match either case going to be paraded in the public view and continually associated with them? This is a violation of privacy and libel if I ever saw it.

    The only answer to our lurker's question "why" is that Smit, Gray, St. Augustin, LW, the Ramseys and apparently CBS would not have a show to put on without hanging names and faces on it, even if those names and faces have nothing to do with these crimes. All they would have is "may be's" and "could be's" and that doesn't make for sensational journalism or "clear" the Ramseys.

    CBS has a new Director of Standards, as a result of the Dan Rather fiasco. Perhaps she will listen to our complaints about the false and malicious allegations of the "48 Hours" producers involved in the latest program on the murder of JonBenet Ramsey. Of special interest are CBS's new standards regarding "materials received from outside sources". Sources such as Michael Tracey, Lou Smit, and John San Augustin.

    Responding to perhaps the most important recommendation of the Panel, we will immediately create a position of Senior Vice President of Standards and Special Projects, reporting to the President of CBS News. This executive will be assigned expanded new duties as part of upholding and enforcing CBS News Standards. Before an investigative report proceeds, the Standards Executive will review the use of confidential sources; will determine the completeness of the authentication and/or chain of custody of materials received from outside sources, ranging from documents to video to photos; and will approve all hidden-camera investigations.

    The Standards Executive will be identified throughout CBS News as someone with whom employees can communicate on a confidential basis, without fear of retaliation, if they have concerns that a planned segment may not meet CBS News standards of accuracy and fairness. This executive will also undertake a comprehensive review of the CBS News Standards Manual and will institute a program for regular review of the standards.

    Assuming this important new role will be Linda Mason, who has been named Senior Vice President, Standards and Special Projects, reporting directly to the President of CBS News.
