Interesting. Do you remember when Lin Wood made the claim that he had never lost a case? Well, that is not true.

SHARON MARIE WENGER V. MARTHA CRENSHAW, M.D. AND STONE MOUNTAIN FAMILY PRACTICE P.C.

    Case No. 90-3069-8

    Verdict Date: June 7, 1990

    RESULT: Defense verdict

INJURY: Unsuccessful abortion and failure to diagnose pregnancy, leading to complications and ultimately, emergency surgery and a hysterectomy.

    STATE: Georgia

    COUNTY: DeKalb County

    COURT: Superior Court

    JUDGE: Jonathan C. Peters

    Age: 31
    Sex: Female
    Occupation: Secretary

PLAINTIFF ATTORNEY: Wayne Grant, Atlanta; L. Lin Wood, Jr., Atlanta

DEFENDANT ATTORNEY: Elaine W. Whitehurst, Atlanta

FACTS: Defendant general practitioner referred plaintiff to an OB/GYN during the 8th week of pregnancy after she requested an abortion. Two weeks later plaintiff presented to defendant complaining of nausea, cramps and spotting. Defendant diagnosed a virus and instructed plaintiff to return if the symptoms did not abate. Plaintiff returned one month later and defendant discovered a mass to the right of plaintiff's uterus. During emergency surgery it was determined that plaintiff had a cornual pregnancy and a hysterectomy was performed.

Plaintiff alleged that defendant was negligent in failing to properly perform a pelvic examination and in failing to heed the signs and diagnose the cornual pregnancy in a timely manner.

Defendant contended that: (1) plaintiff's symptoms were consistent with a virus; (2) she believed the pregnancy had been terminated; and (3) a cornual pregnancy is extremely rare.

I'm surprised that Wood actually had a case that made it to court. The general consensus on the forums was that he had not. I am not surprised that he lied. He's been known to make statements of dubious honesty in the past.

Thank you Easywriter for explaining and doing it in a way I can understand.

EW: If the case is dropped “from lack of prosecutionâ€, or other
reason. That won’t be the end of it. You can bet that Fox News
will sue for their legal costs; so, Wood and the Ramseys are in a
bind that is sure to cost them IF the Fox attorneys have a fix on
what the real situation is. I can’t imagine them not trying to
collect their expenses from the Complainants.

I sure hope you are right!

EW: Do you see the devastation in this for the Ramseys? It would be a
matter of public record that the Plaintiffs could not come up
with a single item of evidence of an intruder. It’s one thing
that this truth is occasionally spoken on the forums, or by Carol
McKinley, but when “no evidence of an intruder†becomes a matter
of trial record, many who have given the Ramseys the benefit of
doubt before will not do so again.

[/I]If it doesn't go to court the Fox attorney's ought to get the court costs back...I doubt Fox will forgive and forget. It sets a bad precidence for other people who try to make their living by suing everyone in sight.

John's brief folly in the political arena may have just cost him a lawsuit.

Have had my hopes up and down for almost 8 years Easywriter...don't worry. The Ramsey's can't win the case...at the very least Fox lets them go with a slap on the hand and Wood and the Rams won't be able to spin losing. It will embarass and be a great financial hardship on John and Patsy.

At the very, very least the Ramseys are going to deeply regret the lawsuit.

Hey Rupert....you got the balls to go after the Swindlers? The Shakedown artist? The killers of 'that' child?

If you do....boy, oh boy will Fox find humongus ratings in the search for justice. Not only justice for Fox, McKinley and all...but mostly justice for JonBenet.
